PLEASE HELP! Chinese Sellers listing counterfeit versions of my product - Amazon Support Does Nothing.

Our brand has been hijacked by several Chinese sellers on Amazon who list our product and then send counterfeit items. We've reported this from every angle possible and despite multiple attempts to address this through Amazon Support and the "Report abuse" tool, I have faced frustrating roadblocks without seeing any resolution.

The impact of these counterfeit sellers extends beyond my brand to numerous other sellers who have also fallen victim to the same counterfeit sellers from China. Amazon, please do something!

My name is Dougal from the Community Manager Team and I will assist where I am able on these other counterfeit products being sold via your listing.

First, Seller Support does not handle IP Violations, Brand Registry does. Counterfeit product IS a type of IP Violation. Because your TM is still pending, you unfortunately cannot report this specific type of violation, but if there are other types of IP violations that these other sellers are doing, those can and should be reported via Report a Violation under the "Protect," menu on the Brand Registry site.

I strongly encourage you to review all of the Intellectual Property for Rights Owners help page. It is a very robust page, but is broken up into specific sections you can use. For example, The section "Main types of IP," breaks down all the IP violations that you can report as well as examples. Another area to highlight is the "Reporting Infringement," section because it has all the steps that you should follow, what to make sure you include and what you should leave out of your complaint.

I cannot review complaint ID's submitted via Report Abuse in the Account Health Dashboard, but I will direct you back there if you are experiencing the following situation, as other sellers have had similar experiences (As you called out).

  • If you complete a test buy and the product does not violate any IP, but is not the same item as you purchased, this needs to be reported via "Report Abuse," of Amazon policies and selecting "The product received is different than the product on the detail page (different version, model or product)," and then provide all the relevant information.

Unfortunately, Amazon will not share the results of their investigation with you per policy. I will say that if you do have an IP violation (that isn't counterfeit) and you are reporting via the Brand Registry site, you will see the complaint progress and if it was accepted or not. I will also be able to see this and can provide any additional help or context as needed.
