Misclassification of Products as Medical Device
Hi, everyone!
I’m reaching out to see if anyone has experience with product misclassification on Amazon. Some of our products have been flagged as medical devices, but they are not.

Has anyone encountered a similar issue? What steps did you take to get the classification corrected and the listings reinstated? Any insights or advice would be greatly appreciated!

I appreciate you raising your concerns with this policy. Understanding that these situations can be rather stressful to deal with, I wanted to offer a bit of guidance to help support you through the situation.
Looking over the two cases you provided I see this involves two ASIN, both ending in "SSBN" & "YG53". Both of these ASIN are active in the US, however I see they do violate our policy in Canada. As your products imply, they are walking boot covers. These being advertised as an accessory to a medical brace makes it so these are seen as a medical device or accessories in Canada. When these are advertised together, they become an orthopedic device or accessory.
Due to the nature of the product, we require that you have proper registration and that they are being manufactured appropriately per the policy issued by Canada. If you're product is unrelated to a medical device or accessory, you will be required to update your listing, to include proof of compliance and meeting all labeling requirements. Without these documents and supporting information, these ASIN will not be eligible for sale in Canada.
If compliance cannot be verified or confirmed, it is advised to fully delete the ASIN to ensure it no longer causes an impact to the account. If these were not intended to be sold in Canada, you may want to review your build international listings tool and ensure it is disabled to prevent unwanted listing migration to other regions.

Thank you for following up on the situation.
I am glad you were able to remove the ASIN and delete the listing.When it comes to removing a violation, this can be a bit more complicated.
There may be a few options depending on what is provided to you in this scenario. Some situations allow the acknowledgement of a violation. If accepted, this removes the violation, but the listing can no longer be used by your store. If rejected the violation remains for the remaining 180-days.
You can confirm this option when clicking on the appeal path in the account health page. You will be presented with a menu and a questionnaire to fill out. Otherwise you may encounter a case requesting a dispute be submitted. This scenario does not allow for an acknowledgement of the violation. If this is your situation, we may only accept a proper dispute as mentioned above in my prior post, or the violation will fall off after the 180-days from the date received.
If the violations are unable to be removed, I always suggest verifying that your current inventory meets our requirements, or that you're correcting and removing what does not. Although at this time it is only impacting the listings, in the future, repeat violations could jeopardize the selling privileges. Due to this, it's always recommended to verify compliance to prevent further impact.
