Brand Registry Appeal Rejection, 3rd USPTO Trademark Filed...How do I get approved?

Hi,

Two weeks ago I shared how my 2nd trademark I applied for was rejected. Amazon Seller Support here on the forums said it was due to my filing being for a "design mark" and USPTO classified it as a "0 - Unknown" category for mark type.

My first 2 trademarks and applications were design marks with logos. So I applied for a 3rd mark, finally a word mark.

I applied a few days ago and got an auto-rejection when the form was filled out. I appealed and I got the classic "Your application was rejected because of either of the following 6 reasons", which is absolutely not helpful.

My USPTO trademark serial # is: 98450605

My Brand Registry Case ID # is: 15043541671

Can someone please help me find out what's going on?

I unfortunately do not have any further information around the teams decision outside of what was provided to you. One or more of those 6 reasons is the cause so I recommend going through each one carefully and addressing what you can.

The team doesn't typically share a lot of information around their decisions to protect their processes around abuse prevention.

did they ask you to provide a real world picture of your packaging with a logo/trademark on it?

I found what may be the problem. On your appliacation did you choose ONE of the two proper "TYPES of DRAWINGS"? It may be that this was not done. You may need to go back to USPTO and submit a correction as your current application shows that it was not selected and has defaulted to NONE. It might need to say "SPECIAL FORM"

Trademark applicants must submit a drawing page with their trademark application, unless the mark is for sound, scent, or other non-visual mark. There are two types of drawings: standard character and special form. Standard character drawings are text only with no color, design, or stylization. Special form drawings include color, design, or stylization. The type of drawing you choose affects the type of protection you receive.

You can use an attorney from Fiverr who will do all the necessary paperwork including a search to ensure that you dont run into a similar name rejection office action. Its worth the $100 and you will not receive anymore rejections from brand registry.
