Branded vs Generic

Hello Everyone,

I am a new seller so excuse my lack of knowledge surrounding this.

I am going down the private label route ordering from a Chinese wholesaler and have a few questions related to branding a product vs generic.

Initially I was under the impression that when doing private label, I could create/name a brand, and sell without having to enroll in brand registry. I am still in the beginning stages and filing for a patent/trademark is a lot of work should this not work out.

Is it still considered private label if I modify the unit and customize the packaging but brand the unit as "Generic"? Is this allowed?

If I created a UPC with a brand name such as "XYZ" but do not have that name patented or trademarked, do I have to create another UPC with the name "Generic" if I want to create a generic branded listing?

Is there any way to list a product with a brand on it, such as my "Brand through Private label" without going through brand registry?

My name is Dougal from the Community Manager Team and I am happy to assist. You do NOT have to enroll in Amazon Brand Registry in order to list your unique brand (Lot's of Sellers do it this way).

You will however still have to submit a Selling Application to sell your brand. I recommend reviewing the Apply to sell a product, category, or brand Seller University video in its entirety, but specifically listing new products starts at the 5:24 mark of the video and does refer back to the "Complete a 'Selling application for Category,' which starts at about 2:19 mark.

If your product is a restricted product, there is a similar video that will walk you through that process on 3.1 Apply to sell a restricted product, category, or brand.

In addition, please review the following policies as you make your decision on how to list:

The key takeaways are once you create an ASIN with a brand name, that brand name cannot be changed and re-branding is not supported. This applies to generic products as well. Meaning, you cannot list a generic product and then once you file a TM change that ASIN brand name from Generic to the new brand name.

For UPC's, Please review the Valid UPCs and Product ID (GTIN) requirements by category help pages. The specific GTIN required for product page creation and matching varies by category. The requirements of each category, including exceptions and exemptions where available, are summarized in the table on the Product ID (GTIN) requirements by category Help page linked above.
