We recently encountered an issue with our application for an APEX ID, which was rejected before we had the opportunity to submit a detailed infringement claim chart. We firmly believe that this rejection may have been made in error. After reading some advice on this forum, we are seeking clarity on our next steps.
Filing a New Application:
Could someone kindly clarify what is meant by "filing a new application"? Does this entail submitting a new application for the same utility patent but potentially with a different infringing ASIN? Or should we consider using the same infringing ASIN?
Engaging an Attorney:
If it becomes necessary to engage an attorney, we are unsure of how to proceed as we do not have an APEX ID case number. Could someone provide guidance on where and how our attorney can contact Amazon to address this issue?
We genuinely appreciate any assistance or insights you can offer in this matter. Your expertise will be invaluable as we work to resolve this situation and ensure the appropriate protection of our intellectual property rights.

I am not part of the team that reviews and accepts or declines the report, however I can answer a few questions and in addition check if there were any errors in the process.

-> To report a new violation, please sign in to Brand Registry, click Protect, and select Report a violation and Indicate that you have an APEX ID. Enter the APEX ID in the text field. If you are not satisfied with the outcome on the last ASIN, please use the same ASIN you reported.

In addition, I tried to look into your brand registry account to see submission details and noticed there were no brands associated with your merchant ID that is used for this forums post. If the submission was from a different account, please let me know any Case IDs that came from this account.
