Received Counterfiet Complaint

Received counterfeit complaint by brand owner. Account health representative could not verify that a test buy was done or not. We buy this product from a distributor and the brand owner is using counterfeit complaints to get the sellers off the listing. We all know that this is not what the counterfeit claims are for. How do you handle it. Amazon is asking for a letter of authorization from brand owner as proof. Clearly the brand owner won't give this and the distributor invoice is not being accepted. Do I just accept - I understand the policy and acknowledge the violation.

This violation is showing critical in my account and showing that my account is at risk of deactivation. I have been selling since 2016 and have never received counterfeit violation. My AHR score was 1000 before this complaint.

Does it mean either way is end of selling on Amazon? It is sad that right owners are misusing the trademark and counterfeit claims to resolve their supply chain problems

@Troy_Amazon can you please guide. I have the distributor invoice for the purchase but not directly from the rights owner. If I submit the invoice and it gets rejected, will I be able to go back and select-

I understand the policy and acknowledge the violation.

I did fail to verify the supply chain as it looks like the rights owner is filing counterfeit claims against all the sellers on the listing even though the product is not counterfeit.

Will accepting this cause my account to be deactivated? I have been selling for 7 years now and this is the first counterfeit complaint and I am getting your account is at the risk of deactivation message on Account Health Page

Anytime I see a statement like this: "We buy this product from a distributor" instead of 'we buy from an AUTHORIZED distributor' I have to guess that you are using some 'mass market' seller with thousands of gray market products and thousands of brands.

The likelihood is they are not authorized distributors of ANY of them in that case.

Have you verified with the BRAND if the source you are using is actually authorized?

Despite your statement "Clearly the brand owner won't give this" have you actually contacted them and asked the question?

Understand that your concern is about received counterfeit complaint by brand owner.

When you sell on Amazon:

* You must comply with all federal, state, and local laws and Amazon policies applicable to your products and product listings

* You may not violate the IP rights of brands or other rights owners

Violating this policy may result in loss of selling privileges or other legal consequences.

Important: This policy is not legal advice. You should consult a lawyer if you have a specific question about your IP rights or the IP rights of others.

There are 3 main types of IP rights:

* Copyrights are legal protections for original works of authorship

* Trademarks are legal protections for a word, symbol, design, or combination of the same that a company uses to identify goods and services

* Patents are legal protections for inventions

Counterfeit claims can be closely associated with authorization. Rights owners can file a counterfeit complaint if an unauthorized seller is selling their trademarked or brand item.

For your case, how do you currently ensure your supplier provide authentically sourced products? we would suggest you to submit requested documents as per notification you have received. Allow us to share some tips that it may helpful for you.

You should submit an explanation through the ‘Submit appeal’ button and include the following information:

-- Letter of authorization or a licensing agreement from the manufacturer or rights owner demonstrating that the Sellers products are lawful; or

-- Invoice.

If you wish to submit an invoice, please check if this invoice is from the brand or authorized distributor. However, please note that even if the distributor is authorized it may not necessarily mean buyers of the distributor are authorized as well. The appeal team may still request you to provide the letter of authorization after the review.

To understand more about Amazon’s IP policy, we would also encourage you to tap on Amazon’s resources such as the Intellectual Property Policy for Sellers here (link to: https://sellercentral.amazon.com/gp/help/G201361070) and Amazon Product Authenticity and Quality here (link to: https://sellercentral.amazon.com/gp/help/G202010130) to aid you in selling on Amazon.

I hope the above information is helpful and please do not hesitate to let us know if your need any further assistance. The forums community and I are here to support you.

Thank you @Seller_rI7BZIczK8iAC and @Seller_kIukTwdhvntAp for your active participation in this thread as well!

Have you received any resolution on this? I'm going through the same issue. Been selling for 7 years. Amazon says the brand owner did a test buy and claims products are counterfeit. It seems this is tactic is being used to remove sellers off listing even though I have legitimate invoices and my distributor is from one of the largest in the nation.

A counterfeit claim has a higher negative impact and my account will be deactivated my account in 2 days.

I've reached out to the brand owner and waiting to hear from them. It seems brand owners don't even need to provide proof of claims that they are making even though it's detrimental to us sellers. In my scenario band x, allows everyone to sell on Amazon. One day a new CEO comes along and decides to get rid of everybody by using this tool, instead of reaching out to sellers and asking them to please stop selling. Amazon is threating to withhold my sales payout and deactivate my account.

Have you received any resolution on this? I'm going through the same issue. Been selling for 7 years. Amazon says the brand owner did a test buy and claims products are counterfeit.
