how to remove an unauthorized seller from my product listing which contains my brand name? any help is appreciated.

Why is it so hard to remove an unauthorized seller from my product listing which contains my brand name?

We have our brand registered on Amazon. We assume that Amazon will help us to remove any intellectual property infringements on our brand name. However, it is not the case.

We emailed and called more than a dozen times for help to remove an unauthorized seller from our brand name product listing. We received emails stating that they understood the issue and offered many hollow apologies. but no actions!

Their responses are the following

1) Report a Violation tool:

However, it only works if the seller creates a new listing with our brand name. It does not apply to our existing product listing. We can not even report it with the link.

2) Visit the Transparency website

it requires that the seller has our trade mark on their product, but they do not have it. We can not report it either.

However, the seller does attach his product under our brand name listing.

How can we remove this unauthorized seller from our brand name listing?

I am aware of an aquarium manufacturer that sold their own products on Amazon well below wholesale. It triggered unfair pricing with Amazon and forced sellers to ditch selling their products on this platform. They did not care / consider the harm they did to their approved sellers. They managed to get the sellers off this platform who were not authorized.

delete the main image, make their inventory stranded... then they will have to wait weeks to get their fba shipment back.... when they remove their listing... add the main photo back... and voila

and amazon support is useless but if you still have control over your listing deactivate the listing by deleting the main image.

Your issue here is that you are claiming "intellectual property infringements on [your] brand name" but there isn't actually any infringement happening.

Amazon can't remove the seller because what this seller is doing is completely legal. There is no infringement here. It's a concept known as the First-Sale Doctrine. You can look it up online but the most important part for you is that you have to PROVE that the item this guy is selling is NOT your item. For all you know, you could have sold these to one of your customers, who then decided they didn't want them, so they are just selling them off super cheap to clear out the inventory.

If you can PROVE, through a test-buy, that these are not your items then you can file a counterfeit claim with Amazon and they will take the sellers offer down.

A note on "unauthorized resellers" - technically, there is no such thing. (Notice I said technically. There are a few scenarios, but as far as Amazon is concerned, they most likely don't apply to your case) Again. First-sale doctrine. According to US LAW, these sellers have every right to resell your products. Amazon doesn't take action because they CAN'T legally take action.

You also asked why you signed up for brand registry - if you didn't you wouldn't be able to list your branded products, you wouldn't be able to file claims on ACTUAL infringement, no A+ content, no brand analytics...the list goes on. Signing up for Brand Registry provides MANY benefits and protections that you wouldn't otherwise have access to.
