Amazon section 3 violation

Hello everyone,

I've received an email from Amazon that my account is being deactivated due to violation of Amazon section 3 on the product which I just listed and never sold a single unit.

What happened is that I've found a product and listed it and later try to source it, I've found the supplier and I bought that product but when I seen the product invoice from the supplier, I doubt about the product authenticity, I quickly canceled the shipment and told my supplier that not to ship it, but because I've already sent the SKU's of the units and shipment, my supplier sent the shipment which (I feel with dishonest intentions) after that the shipment reached to Amazon fulfillment center but never go live to sell to the customers.

I my supplier for refund, he repeatedly said that I'll refund if the inventory would return to me, I created a case with Amazon and tried to get that shipment return to my supplier but Amazon said that you've cancelled the shipment and we don't have any record and let you know if we found it later.

Recently my account got deactivated and Amazon is asking for the invoice of that same product which never went live on my account to sale but only listed on my account, I've submitted the invoice that is provided by my supplier but Amazon is not accepting it, I know that invoice would not be accepted that is why I take those precautionary measures and bear the lose of that inventory, I've explained all my situation in my appeal to Amazon but they're still not accepting it, account expert stating that it doesn't matter that the product went live or not but you've to provide the invoice because you've listed the product on your seller account.

If anyone knows how I can solve this issue, Please help !

Here is some actual advice instead of " you should have" responses

You really do not have a choice but to fess up to Amazon that you failed in doing your research prior to listing the product and that you put the cart before the horse. you underestimated the importance of pre-validating your suppliers.

The appeal should contain evidence you have went through ENTIRETY of Amazon university pages and videos (don't just say you did, Amazon knows if you went and watched the videos or not)

Explain how you failed to meet expectations point out specifics from seller university that pertain to your willful ignorance in sourcing authentic product FIRST. and how you are performing 1, 2 and 3 4 5 ----10 that will without a doubt prevent a reoccurrence.

You WILL be giving up all sources and if the product was really junk what you did to report that supplier with evidence of such will go a long way for a LONG SHOT to getting reactivated.

So.. There is $1500 worth of advice .. free of charge.

Move on. You will never get reactivated if you cannot provide a valid invoice.

Why is that much big punishment just because of listing a product, It's against the ease of doing business.

My understanding was the section 3 apply to the product which go live to customers, I really regret that I didn't delete the listing and also very disappointed that my account is deactivated.

You obviously did not research selling on Amazon before you jumped in headfirst. You are now deactivated and will not be able to sell on Amazon again. And it wouldn't have mattered if you deleted the listing, you posting with the intention to sell it, and that's all they need.

Ofcourse I posted with the intention to sell but I stopped after finding the problem, I could have sell the doubtful product and the result would be the account deactivation but I didn't do it because it was doubtful and the result is still the account deactivation.

I always wanted to do the business fairly and with honest intentions.

You're right that my understanding and research was not accurate enough but I never intended to do anything which not fair, but I would have researched more because It's not always about intentions.

Amazon is a business; they don't give second chances. They assume you have done your research/due diligence.

It's better that Amazon should make the invoice mandatory before listing a product if they want to protect both brands and sellers instead of assuming that sellers have did due diligence, this would save so many people from loosing their capital and their business.

Verifying the authenticity of a product, and your authorization to sell it, is expected to be done BEFORE you list it. Even if you never have any inventory on the listing, Amazon still expects you to prove authenticity.

Harsh? Perhaps. But it's to protect Amazon from liability.

One might also ask "Why would a seller create a listing for an item which he does not have?" I have to wonder how you know that the listing is correct if you don't actually have the product to refer to.

All New Sellers, take note, HERE is where they made their error:

Never, Ever, Ever make (or join) a listing unless you physically have the product In-Stock and are Ready-to-Ship.

Period.

This Seller was absolutely backwards, they found a product, listed it, and THEN tried to source it.

The second mistake was beginning as FBA instead of FBM. One of the MANY pitfalls selling FBA is the ever-present possibility that Amazon will not only declare your FBA Inventory to be somehow Invalid, but almost always refuse to Return it back to you.

I have to wonder what happens to ALL of the FBA Inventory "Seized" by Amazon? I rather doubt it is tossed in the trash and so assume that Amazon sells it themselves to someone, somewhere...

I agree that you are almost certainly DONE here without a Valid Wholesale Invoice for this product, which even YOU feel is probably inauthentic to begin with, and so are unlikely to ever get.

Good Luck where you land. Learn from this so you don't repeat these mistakes next time.
